Terms of Service

These terms are a binding agreement between you and Hello Thesa LLC covering your use of the LeadAIvisor website and application. By creating an account or using the service, you accept them.
1. What the service is
LeadAIvisor connects to an advertising account you own, launches advertisements you select from a library, and delivers the resulting leads back to you. Access is granted by approval. We may decline or revoke access at our discretion.
2. Your account
- You must be at least eighteen and authorized to act for the business you represent.
- You are responsible for your login credentials and for everything done under your account.
- Information you give us at signup must be accurate.
3. Your advertising account and your spend
You pay Meta directly. We never do. Advertisements run in your own Meta advertising account, on the payment method you have on file with Meta. LeadAIvisor does not hold, bill, or refund your advertising spend, and we are not responsible for the amount Meta charges you.
You set the budget. We enforce the budget you set and the limits configured for the advertisement you selected. You remain responsible for monitoring your own spend.
4. Advertising rules and content
- You must comply with Meta's Advertising Policies and Commerce Policies at all times.
- Advertisements we supply in the library are screened by us, but you are the advertiser of record and remain responsible for what runs in your account.
- If you write your own advertisement copy or upload your own images, you warrant that you own or have the right to use that content, and that it is truthful and not misleading.
- We screen customer-created advertisements before launch and may refuse to launch anything we believe violates Meta's policies or the law. That screening is a safeguard, not a guarantee.
- You may not advertise anything unlawful, deceptive, discriminatory, or prohibited by Meta.
Meta may reject, pause, restrict, or remove advertisements, or restrict your advertising account, for reasons outside our control. We are not liable for those actions.
5. Leads and how you may use them
People who submit a lead form are your prospective customers. You are responsible for contacting them lawfully. That includes obtaining any consent required for calls, text messages, and email under laws such as the Telephone Consumer Protection Act and the CAN-SPAM Act, and honoring opt-out requests. You may not sell or transfer lead data in violation of Meta's Lead Ads terms.
6. Acceptable use
You may not:
- Attempt to circumvent the limits, guardrails, or approval steps built into the service.
- Reverse engineer the service, or attempt to extract the instructions or configuration of the assistant.
- Use the service to access an advertising account you do not own or are not authorized to manage.
- Interfere with, overload, or probe the service or its infrastructure.
- Resell or provide access to the service to a third party without our written agreement.
7. The assistant
LeadAIvisor includes an assistant powered by a large language model. Its output is generated and may contain errors. It is provided to help you complete the steps of launching an advertisement. It is not legal, financial, tax, or professional advice, and you should not rely on it as such. You are responsible for reviewing what you launch.
8. Fees
Where a paid plan applies, fees are stated at the time you subscribe, are charged in advance, and are non-refundable except where required by law. We may change pricing on notice to you before the change takes effect.
9. Intellectual property
We own the service, the advertisement library, and everything in it. You receive a limited, revocable, non-exclusive right to use the service while your account is in good standing. You own your business information, your advertisement copies you create, and your leads.
10. Suspension and termination
You may close your account at any time. See our Data Deletion Instructions. We may suspend or terminate your access immediately if you breach these terms, if we are required to by Meta or by law, or if we believe your use puts our service or other customers at risk.
11. Disclaimer
The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not promise any particular advertising result, cost per lead, lead volume, or return on advertising spend.
12. Limitation of liability
To the fullest extent permitted by law, Hello Thesa LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost leads, or lost data. Our total liability arising out of or relating to the service will not exceed the greater of one hundred United States dollars or the amount you paid us in the twelve months before the event giving rise to the claim. Advertising spend paid to Meta is not an amount you paid us.
13. Indemnity
You will defend and indemnify Hello Thesa LLC against claims arising from your advertisements, your use of lead data, your breach of these terms, or your violation of law or of Meta's policies.
14. Changes to these terms
We may update these terms. If a change is material we will notify account holders by email before it takes effect. Continuing to use the service after that means you accept the change.
15. Governing law
These terms are governed by the laws of the United States and of the state in which Hello Thesa LLC is organized, without regard to conflict of law rules. Disputes will be brought in the courts located there.
